Selling a Co-owned or Inherited Prague Apartment Building

Family flat with a tiled stove in an apartment building

Many Prague apartment buildings are family assets that have passed to several heirs. One wants to sell, another wants to hold, and a third needs money immediately. Selling in this situation requires not only market expertise but also agreement.

Selling the whole building together

Selling the whole building usually delivers the best financial outcome, as the investor pays for control over the entire property. Individual ownership shares typically sell at a discount because the buyer acquires only limited rights.

The key is for co-owners to agree on the process: who represents them, the minimum price and how offers will be assessed. We recommend putting this agreement in writing before approaching investors.

An independent valuation as the basis for agreement

Disputes between co-owners often arise from differing views on value. An independent, clearly explained valuation, including an income-based valuation calculation and a price range, helps establish common ground.

A managed sale process also gives all co-owners the same information at the same time, removing suspicions that anyone is acting behind the others’ backs.

Selling an ownership share

If agreement is not possible, a co-owner can sell their share. Any pre-emption rights and conditions imposed by law or by agreement between the co-owners need to be checked. The pool of buyers for ownership shares is smaller and the price lower, but for some owners this is the only option.

An inherited building

Before a sale, inheritance proceedings must be completed and ownership registered in the Land Registry. Tax matters, including the qualifying ownership period for tax exemption and whether the deceased’s period of ownership counts towards it, should be addressed at the outset. Heirs also often lack a complete set of records, such as tenancy agreements, statutory inspection reports and property documentation. Obtaining the missing records is part of preparing for the sale.

Frequently asked questions

Can we make decisions on offers together?

Yes. In a managed sale process, all co-owners receive the same reports and make decisions according to agreed rules.

What if one co-owner disagrees?

The other co-owners could consider buying out that owner’s share, or selling their own shares. We recommend consulting a solicitor on the appropriate course of action.
